Syrian internet goes down, gets cut off from the world

The civil war-torn nation of Syria has seemingly disappeared from the internet. In a sign that the regime of President Bashar al-Assad is trying to limit the flow of information and possibly increase its violent crackdown on opposition forces, all 84 blocks of IP addresses used by the nation have gone offline. The blackout was first reported by Renesys this morning at around 5:26am ET and the #SyriaBlackout hashtag has started picking up steam on Twitter as others have noticed. While it's unclear exactly what has happened and investigations are on going, and a nationwide outage is highly suspicious. The Associated Press is reporting that rebels are laying blame for the blackout at the feet of the government and that cellphone service has also been severed. We'll update as more information rolls in, but we wouldn't expect good news.

Update: Akamai has provided more confirmation of the outage. As you can see in the image above, at some point this morning the amount of data coming out of Syria simply dropped to zero.

We have already mentioned that on the eve of the war against Napoleon Russia was gripped by Francophilia. But it would be wrong not mix ?Belle France? which was so much adored by Russian Francophiles and Napoleon?s Empire ? the sizes and borders of those two Frances did not coincide.

It looked as if ?Belle France? was occupied and forcefully made part of the state established by a revolutionary ?parvenu? and intriguer, whom Russian Francophiles called by his plebeian name ?Buonopartia?. When they pronounced Napoleon?s family name this way they stressed that they did not recognize his title.

Although they were brought up in French culture the Russian aristocrats remained isolated from the rest of the world in terms of information so they were not very much advanced even in comparison with their servants and serfs. As for the lower middle class people many of them were interested in international politics and read handwritten copies of works by Wilhelm Friedrich Hezel, professor at the Derpt University, who tried to prove that Napoleon was Antichrist (on the base of his scientific studies of the Apocalypses). The professor was dismissed for his controversial statements but his works became wide spread.

The Russian aristocracy welcomed the news that Napoleon had married Austrian princess Maria-Louise hoping that this would put an end to his victories. Such forecasts came from beliefs that Napoleon?s first wife Jos?phine de Beauharnais was a witch and accompanied her husband in all his campaigns. She could turn into a dove, flew above the positions of the enemies and returned with valuable information which gave Napoleon a serious advantage over his rivals. But God punished Jos?phine and she could not be a mother. In order to prolong the dynasty Napoleon left her and married the Austrian princess but he also lost Jos?phine?smagic support.

In 1811, in Moscow the ladies from the Russian aristocracy circle devised a plot against Napoleon. They decided to kill him using witchcraft practices. Sticking needles into a wax figure of Napoleon they hoped that it will kill the real French Invader. When later they saw that their attempt was useless they declared that Napoleon was the Evil spirit child, an evil magician who was immune to the spells of amateur witches.

When the war broke out nobody was confident of Russia?s victory. This caused agitation which assumed different forms. In particular, when common people heard French talking in the streets they caught Francophiles beat them and brought them to police.

But soon after Napoleon left Moscow and led his army towards a terrible disaster, the pre-war Francophile sentiments gripped the Russian society again. Russian noblemen took new tutors from the prisoners of war. The captured Frenchmen quickly adapted to the new situation and some of them even became favorites in their Russian families. Many of them assimilated in Russia and decided not to leave the country where they could lead a happy life by simply being French.

When the ladies who waited out the war in their country mansions returned to Moscow they saw that many shops had French names. Russian noblemen took dance classes from the renowned French dancers of that time and French theater companies were giving performances in Moscow.

Alexander I granted amnesty to all subordinates of the Russian Crown who had been forced by the war time circumstances to serve the enemy. He also announced the restitution which guaranteed the return of the property which had been confiscated.

Life in Russia resumed its natural course, there was no trace of yesterday fears and exasperation. Though the war was Patriotic it did not start hate between the Russian and French nations. This is how most of the wars ended when Europe did not know ideological and ethnical divisions.

(AP) ? Satellite photos indicate North Korea has moved two sections of a long-range rocket in preparation for a launch that would alarm both its adversaries and lone ally China.

But North Korea has yet to announce its plans, leaving some uncertainty whether and when it will proceed with a launch that would be sure to draw international condemnation.

The U.S.-Korea Institute at Johns Hopkins School of Advanced International Studies said Thursday the recent activity at the Sohae site on North Korea's northwest coast suggests it could be ready to launch a three-stage rocket by the end of the first week in December.

A commercial satellite photo taken Monday shows two long trailers, likely used to carry the first two stages of a rocket, according to an analysis written for 38 North, the institute's website. The trailers are parked near the main missile assembly building, where it says rocket stages would be checked before moving to the launch pad for takeoff about a half-mile away.

In April, North Korea fired a rocket from the same site in a failed attempt to launch a satellite into space, drawing U.N. censure as that technology can be easily converted into use for missiles. The launch dashed prospects for a resumption of international aid-for-disarmament talks.

South Korean officials confirmed Thursday there are signs of preparations at the rocket site. A launch in the next few weeks would be seen in Seoul as timed for South Korea's Dec. 19 presidential election.

Victor Cha, a former White House director of Asia policy, said Pyongyang has a track record of reacting to elections in both the U.S. and South Korea in provocative ways, most recently when President Barack Obama took office in 2009. North conducted a rocket and nuclear test within four months.

Another motivating factor for the North could be that South Korea recently won U.S. approval to expand its ballistic-missile range, and this week, was readying its own satellite launch. However, it scrapped those launch plans Thursday, citing technical problems.

North Korea conducted nuclear tests in 2006 and 2009, and Washington says Pyongyang uses long-range rocket launches to develop missiles that could target the United States, although it is not yet believed to have miniaturized a nuclear device to mount on a missile.

A rocket launch would not only dismay the U.S. and its allies, but the North's chief ally and source of economic support, China, which is midway through a leadership transition.

"If North Korea does carry out a launch, Beijing will not be happy," said Evans Revere, a former senior U.S. State Department official and expert on East Asia. "It flies in the face of China's request for North Korea to reduce tensions in the region and not escalate them."

Past launches have happened in spring or summer when weather conditions are better, but according to the analysis on the institute's website 38 North, there are several telltale signs that one is being readied now.

As well as the trailers, the images show empty tanks in four locations suggest fueling preparations. There's work under way at an instrumentation site that would monitor a launch. Also, temporary structures for keeping the snow off cars have been erected near a building used to house visiting VIPs.

But any launch could still be weeks away. The analysis notes that North Korea has yet to provide notification for international flight and shipping of splashdown zones for the used rocket stages, as it did before the April launch. Nor has it filed a plan for a frequency for a signal that would be emitted by a satellite.

David Wright, a physicist with the Union of Concerned Scientists, said the launch preparation so soon after the April failure "calls into question whether the North could have analyzed and fixed whatever went wrong." North Korea has yet to successfully test a rocket with a range of more than 800 miles.

Another failure would embarrass young North Korean leader Kim Jong Un, not yet a year in the job after the death of longtime ruler Kim Jong Il, his father.

Fed's Evans wants more easing, Fisher wants limits

TORONTO/BERLIN (Reuters) - Deep divisions at the Federal Reserve were on display on Tuesday, just two weeks before the U.S. central bank's next policy-setting meeting, with one top Fed official pushing for more easing, and another advocating limits.

The divide underscores the hurdles Fed Chairman Ben Bernanke faces as he tries to win consensus among his fellow policymakers on the central bank's sometimes controversial efforts to bring down the nation's lofty unemployment rate, which registered 7.9 percent last month.

Charles Evans, president of the Chicago Federal Reserve Bank and one of the Fed's most outspoken doves, said interest rates should stay near zero until the jobless rate falls to at least 6.5 percent. Such a policy would carry "only minimal inflation risks," and could boost growth faster than otherwise, he said.

Evans, who rotates into a voting seat on the Fed's policy-setting panel in January, also said the Fed should step up its program of quantitative easing in the new year to keep its overall level of asset purchases at $85 billion a month for most, if not all, of 2013.

But Dallas Fed President Richard Fisher, a self-identified inflation hawk, said the U.S. central bank could get into trouble if it does not set a limit on the amount of assets it is willing to buy.

"You cannot expand without limits without horrific consequences," he told reporters on the sidelines of the conference organized by the Levy Economics Institute in Berlin. "There is no infinity in monetary policy, we know that from the German experience."

In September the Fed launched an open-ended asset-purchase program, kicking it off with a monthly $40 billion in mortgage-backed securities and promising to continue or ramp up the program unless the outlook for the labor market improves substantially.

Those purchases come on top of the $45 billion in long-term Treasuries the Fed is buying each month under Operation Twist, purchases that are funded with sales of a like amount of short-term Treasuries.

"It's important to maintain the overall level of asset purchases at $85 billion, at least for a time until we can see whether or not we are doing better or things are going more slowly, and we can adjust, depending on that assessment," Evans told reporters attending a speech at the C.D. Howe Institute in Toronto

"I think we have to have discussion about what is 'substantial improvement.' Have we seen it? In my opinion, we have not," he said.

Evans said he would judge the labor market as substantially improved once he sees monthly job gains of a least 200,000 for about six months, as well as above-trend growth in gross domestic product that would lead to declines in unemployment.

"I would be very surprised if we could achieve that before six months have passed, and I would not be surprised if it takes until the end of 2013," he said.

Evans said the Fed should keep rates low well beyond that date, until the jobless rate hits at least 6.5 percent, as long as the inflation outlook for the next two to three years remains below 2.5 percent. The Fed's inflation target is 2 percent.

Evans for the past year had called for low rates until the jobless rate falls to 7 percent, as long as inflation does not threaten to breach 3 percent.

On Tuesday Evans said he now views a 7 percent unemployment threshold as "too conservative," and sees a 2.5 percent inflation safeguard as appropriate, given that a higher threshold makes some people "apoplectic" and is not needed in order for the policy to work.

"We're much more likely to reach the 6.5 percent unemployment threshold before inflation begins to approach even a modest number like 2.5 percent," he said.

Fed policymakers have been ramping up discussions on so-called thresholds - economic data points such as specific unemployment and inflation rates - that would signal when the central bank is likely to begin raising benchmark interest rates from near zero.

Minneapolis Fed President Narayana Kocherlakota, Boston Fed President Eric Rosengren and the Fed's influential vice chair, Janet Yellen, have all expressed support for the idea.

In Berlin, Fisher also chimed into the debate.

"One option I believe we might pursue is to have a definition of our unemployment target as well as our long-term inflation target," he said, noting it would be difficult however and setting an overall limit on asset purchases was preferable.

Fed Chairman Bernanke said last week that adopting numerical thresholds for unemployment and inflation could be a "very promising" step to develop the Fed's communication strategy, but stressed that it was still under discussion.

On at least one issue, Fisher and Evans agreed: lack of jobs, not high inflation, is the biggest problem for the U.S. economy.

"I am not worried about inflation right now, I am worried about an underemployed workforce in America," said Fisher.

Use the "Embarrassment Test" to Help Make Difficult DecisionsNobody likes making a difficult decision, but if you're really struggling between choices, blogger Eric Koester suggests using what he calls the "embarrassment test" to help guide you along the right path.

The idea is to imagine the conversation you'd have defending your decision, and then thinking about if you'd be embarrassed defending it. Koester explains:

I like to use the Embarrassment Test. When you are making a decision that is a toughie or just could go either way, I think the best course of action is to gather up all the facts and rationales for your decision, and imagine a conversation with someone you trust... In that imaginary conversation, dump that pile of information onto your confidant and then ask yourself the following question:

"Would I be embarrassed to offer them this rationale for my decision?"

When you do this, you're effectively testing your gut. You might realize you're more confident in your decision than you thought, or you might find that you need to do more research because your rationale doesn't hold up.

Athens, Ga. Researchers at the University of Georgia have discovered that a virus commonly found in dogs may serve as the foundation for the next great breakthrough in human vaccine development.

Although harmless in humans, parainfluenza virus 5, or PIV5, is thought to contribute to upper respiratory infections in dogs, and it is a common target for canine vaccines designed to prevent kennel cough. In a paper published recently in PLOS ONE, researchers describe how this virus could be used in humans to protect against diseases that have eluded vaccine efforts for decades.

"We can use this virus as a vector for all kinds of pathogens that are difficult to vaccinate against," said Biao He, the study's principal investigator and professor of infectious diseases in UGA's College of Veterinary Medicine. "We have developed a very strong H5N1 flu vaccine with this technique, but we are also working on vaccines for HIV, tuberculosis and malaria."

PIV5 does not cause disease in humans, as our immune system is able to recognize and destroy it. By placing antigens from other viruses or parasites inside PIV5, it effectively becomes a delivery vehicle that exposes the human immune system to important pathogens and allows it to create the antibodies that will protect against future infection.

This approach not only ensures full exposure to the vaccine but also is much safer because it does not require the use of attenuated, or weakened, pathogens. For example, an HIV vaccine delivered by PIV5 would contain only those parts of the HIV virus necessary to create immunity, making it impossible to contract the disease from the vaccine.

"Safety is always our number one concern," said He, who is also a Georgia Research Alliance distinguished investigator and member of the Faculty of Infectious Diseases. "PIV5 makes it much easier to vaccinate without having to use live pathogens."

Using viruses as a delivery mechanism for vaccines is not a new technique, but previous efforts have been fraught with difficulty. If humans or animals already possess a strong immunity to the virus used for delivery, the vaccine is unlikely to work, as it will be destroyed by the immune system too quickly.

"Pre-existing immunity to viruses is the main reason most of these vaccines fail," He said.

But in this latest study, He and his colleagues demonstrate that immunity to PIV5 does not limit its effectiveness as a vaccine delivery mechanism, even though many animalsincluding humans already carry antibodies against it.

In their experiments, the researchers found that a single dose inoculation using PIV5 protected mice from the influenza strain that causes seasonal flu. Another single dose experimental vaccine also protected mice from the highly pathogenic and deadly H5N1 virus commonly known as bird flu.

This recent work is a culmination of more than fifteen years of research and experimentation with the PIV5 virus, and He has confidence that it will serve as an excellent foundation for vaccines to treat diseases in both animals and humans.

"I believe we have the best H5N1 vaccine candidate in existence," He said. "But we have also opened up a big field for a host of new vaccines."

NRA to promote composting at national conference - NRA News Blog

The U.S. Composting Council will hold its 21st annual conference and trade show Jan. 27-31, 2013 in Orlando, Fla.

Titled "The Magic of Compost", the conference will kick off Jan. 27 with the USCC's first golf outing and benefit at Hawk's Landing Golf Club at the Orlando World Center Marriott.

Breakout sessions and discussions will focus on such topics as composting growth from a national and regional perspective, municipal planning and composting, compostable packaging, and legislative updates on new rules and ban repeals.

Scott DeFife, the National Restaurant Association's executive vice president of policy and government affairs, will participate in the conference's "Panel of Industry Leaders: Opportunities and Barriers to Compost Industry Growth", and Jeff Clark, a sustainability consultant for the NRA's Conserve program, will discuss outcomes from a recent research project conducted in partnership with Duke University that studied barriers to restaurant industry's adoption of composting efforts.

In September, the NRA and the USCC announced their intent to partner on increasing composting education and activities nationwide. Under the terms of the agreement, the organizations will share educational resources and seek to identify collaborative opportunities that benefit their constituencies and the general public by promoting awareness of the important role composting plays in waste reduction and improved soil and water quality.

I wanted to write a post about the Light the Night walk we attended in Dallas TX this year.? It?s been 2 years since we last attended a walk due to just having a baby and then being too busy but we are supporters of the Leukemia and Lymphoma Society.? My husband is a leukemia survivor.? He was diagnosed with AML (acute myeloid leukemia) in 2000.

?

He told me that he found out on a Friday from the doctor that thedallas tx, light the night walk, leukemia lymphoma society leukemia was pretty well established in his body.? The doctor wanted him to go to the hospital for treatment that very minute.? He had already had plans to go camping that weekend and decided that he needed time to process what he?d just been told.? He entered the hospital that following Monday to begin his treatment of chemotherapy, full body radiation, and another round of chemotherapy.? This was followed by a bone marrow transplant by one of his brothers(he has 7) for a full recovery.? This year is his 12th Rebirthday.

?

We have known many others of our friends that have been touched by the steele's at Dallas' Light the Night Leukemia walkleukemia and lymphoma, as well as other cancers.? If you are feeling generally different than normal and tired, or there?s something under your skin that just doesn?t feel right, make sure you visit the doctor.? If you have cuts that don?t heal, frequent minor infections, aches in your bones and joints and other symptoms, get checked out. ?Even if you?re scared or nervous that something is wrong what if something is wrong.? He?s at stage 3 and treatment is much more aggressive than it would have been and it?s possibly spread.?

So every year we fundraise for the LLS to help them with patient care, treatment, research and development and information. ?We?ve been able to visit labs in San Diego where they do research on these blood cancers and try to downtown dallas tx, light the night 2012 leukemia lymphoma walkcome up with better treatment options for people who are diagnosed.?

?

This Light the Night Walk is just one of many ways the local Dallas Fort Worth chapter fundraises during the year. ?It was held in Downtown Dallas and had a great turnout.? It makes you feel good surrounded by others who have gone through this cancer or known someone that has.? It is an honoring and memorializing night as well.? We walk in honor of my husband who beat it, in addition to two of our friends, one who had lymphoma diagnosed and beat when she was only 35 and another diagnosed with leukemia when she was only 3(she?s now 8).?

?

Face-washing tips for healthier-looking skin

ScienceDaily (Nov. 13, 2012) ? Washing your face is as simple as using soap and water, right? Not quite say dermatologists. How you wash your face can make a difference in your appearance.

"It's important for people to treat the face with care. Never scrub the skin or use harsh products as doing so irritates the skin, which makes skin look worse," said Thomas E. Rohrer, MD, FAAD, a board-certified dermatologist in private practice in Chestnut Hill, Mass.

For healthier-looking skin, Dr. Rohrer recommends people follow these tips to keep their face looking healthy:

1. Use a gentle, non-abrasive cleanser that does not contain alcohol.

2. Wet your face with lukewarm water and use your fingertips to apply cleanser. Using a washcloth, mesh sponge or anything other than your fingertips can irritate your skin.

3. Resist the temptation to scrub your skin as scrubbing irritates the skin.

4. Rinse with lukewarm water, and pat dry with a soft towel.

5. Apply moisturizer if your skin is dry or itchy. Be gentle when applying any cream around your eyes so you do not pull too hard on this delicate skin.

6. Limit washing to twice a day and after sweating. Wash your face once in the morning and once at night as well as after sweating heavily. Perspiration, especially when wearing a hat or helmet, irritates the skin. Wash your skin as soon as possible after sweating.

"A board-certified dermatologist can answer your questions about how to care for your skin, hair and nails," said Dr. Rohrer.

Glutamate neurotransmission system may be involved with depression risk

ScienceDaily (Nov. 13, 2012) ? Researchers using a new approach to identifying genes associated with depression have found that variants in a group of genes involved in transmission of signals by the neurotransmitter glutamate appear to increase the risk of depression. The report published in the journal Translational Psychiatry suggests that drugs targeting the glutamate system may help improve the limited success of treatment with current antidepressant drugs.

"Instead of looking at DNA variations one at a time, we looked at grouping of genes in the same biological pathways and found that a set of genes involved in glutamatergic transmisson was associated with the risk of depression," says Jordan Smoller, MD, ScD, director of the Psychiatric and Neurodevelopmental Genetics Unit in the Massachusetts General Hospital (MGH) Department of Psychiatry, senior author of the study. "Our findings are particularly interesting in light of recent studies showing that drugs affecting glutamate transmission can have rapid antidepressant effects."

While the risk of depression clearly runs in families, the genome-wide association studies typically used to identify gene variants that increase disease risk have been unable to find strongly associated genes. The research team -- which includes investigators from the Broad Institute of MIT and Harvard and other research centers in the U.S., Australia and the Netherlands -- adopted a strategy called gene set pathway analysis.

Starting with a set of genes that previous studies had implicated in depression, they used an analysis process called text mining to scan the medical literature for information on the biological function of these genes. Based on those findings, they identified 178 biological pathways that included these genes. Only one of those pathways -- the one involved in transmission of neural signals carried by glutamate -- was significantly associated with the risk for depression.

"Glutamate is the excitatory transmitter most widely used by the central nervous system, and several studies in animals and humans have suggested that it may play a role in depression," explains Smoller, an associate professor of Psychiatry at Harvard Medical School. "Most intriguingly, recent studies have found that ketamine -- a drug known to block one glutamate receptor -- appears to have antidepressant effects that are much faster than those of traditional antidepressants, which can take several weeks to become effective. Now additional research needs to confirm these findings and investigate exactly how variation in glutamate function affects brain systems involved in depression."

10 roadblocks to implementing Big Data analytics | TechRepublic

Takeaway: Before you jump on the Big Data bandwagon, make sure you understand exactly what you?re getting into.

Big Data and business analytics are two of the most exciting areas in business and IT these days ? but for most enterprises, they are still developmental. Although the opportunities are boundless, the road to an effective Big Data operation is fraught with challenges. Here are some of the obstacles companies are encountering ? and some ways to get around them.

1: Budget

Traditional servers in enterprise data centers are not designed for processing Big Data. Minimally, analytics servers, and in some case high performance computing (HPC) servers and applications, will be needed. This will require new IT investment. The key to success here for the CIO is to build a business case in plain English so that others in the organization (like the CFO) can understand why servers already installed in the data center can?t be repurposed to work with Big Data. The CIO should have this understanding (and buy-in) in place before making any IT investment.

2: IT know-how

Big Data doesn?t process like online transactional data does ? and it requires a different strategy for both storage and processing. Big Data processors run several processing threads in parallel as they work the data. They do not proceed sequentially, as they do when they?re processing online transactions.

Storage strategy must also change. This starts with a tiering of storage that places the most sought-after data on faster storage devices, such as cache/solid state disk, and less frequently accessed data on slower hard disks. There are turnkey automated storage tiering solutions on the market. But ultimately, many IT departments want to formulate their own rules for how Big Data is prioritized and accessed. This requires a level of strategic expertise from storage professionals that IT departments haven?t demanded before. CIOs can prepare their storage staff for a heightened role by ensuring that they are included in IT strategic planning meetings ? and that they have the latest in storage management training.

3: Business know-how

Business analytics and Big Data vendors are eager to knock on your door with turnkey reports and easy ways to get started with Big Data ? but all too often, the tendency of end business users is to ask that the top 10 to 20 reports they?ve been using for the past 15 years get converted to the new solution first. This isn?t a good way to use Big Data ? or to help the company get closer to answering tough business questions that have eluded it in the past. Knowing how to query Big Data to answer the big questions is also where present skills fall short in businesses. One way to grow this skills area is to contract with the vendor (which usually has Big Data trainers and specialists on staff) to provide Big Data/business analytics training to end users as part of the solution implementation process.

4: Data cleanup

Big Data and business analytics are only as good as the data itself. This is why cleaning up data to ensure that incomplete, inaccurate, and duplicate data is removed should be the first step of any Big Data project. The CIO must explain this and secure top management?s support for a Big Data cleanup, which will seem to those on the outside as a lot of effort expended for no tangible results. The best approach to selling the process is to present the facts upfront so there are no surprises.

5: The storage bulge

The amount of data under management in enterprises has grown five times over the past four years. And while this has happened, we have gotten no better at managing data. If enterprises are going to harvest the kernels of wisdom buried in Big Data, they are first going to have to find ways to unravel it. This begins by sorting through the data, deciding what is important, and either archiving or getting rid of the rest.

6: New data center workloads

Enterprise data centers are organized around online transaction processing, which functions at priority one. Batch processing is run at night or at low priority during the day. With business analytics and Big Data, there is now a call to run real-time analytics at high priority so that retailers can analyze and respond to who is buying what at the same time the buying activity is taking place. This means that data center operations have to change so they also reflect these new priorities.

The best way to effect the transition is to get your IT staff engaged in analyzing the workloads currently run through the data center to determine how they will likely change and which area of IT daily operations will also have to change. The sooner you begin this process, the sooner your data center will be positioned for Big Data ? and the less uncertainty your staff will experience.

7: Data retention

One of the major causes of data accumulation in organizations is a fear of permanently losing that data. E-discovery law is a good example. Your company might be subpoenaed for every email ever written for the last 10 years. And regulators might require that you keep your data for many years. Nevertheless, it?s still IT?s job to assume a lead role in working with different end-user departments to set data retention policy and to determine what happens to data (archiving or elimination) at the end of retention timeframes. This somewhat clerical task is often at the bottom of IT?s to-do list. But for Big Data management, data retention policies (and enforcement) need to be toward the front of the list.

8: Vendor role clarification

Because so many organizations are inexperienced with Big Data, many vendors offer turnkey solutions complete with prefab analytics reports. These reports are great for getting started, but you?ll want to start developing your own internal expertise. Make sure that your vendor understands this so it can be a strong business partner.

9: Business and IT alignment

Business goals and IT Big Data strategy should be tightly aligned before any IT investments are made. Ultimately, C-level executives are going to look back to see whether they really were able to answer the big questions and gain competitive advantage for the company through the use of Big Data. Do you want to predict when there will be a disruption to a supply chain so you can rearrange your logistics to still be on time with your order fulfillment? Is it important to know when a certain buying trend first emerges so you can be first to market? Know what you are going after before you invest in Big Data and analytics.

10: Developing new talent

Everyone is scrambling to find people who can run Big Data and business analytics. Who are these people? Some are statistical engineers who are trained in logic, mathematics, computer science, and complex problem-solving involving huge amounts of data. These data engineers and analysts are not the people currently performing analysis and programming on your IT staff. That?s why many companies initiating Big Data and business analytics projects either hire consultants to train their people or look to hire data engineers. Data engineers are in high demand and they are very expensive. For CIOs, fostering an aggressive training program for internal staff members whom you believe you can develop into Big Data specialists might be the best bet.

General Duty of Care -

The Model Work Health and Safety legislation sets out duties of care on a wide number of workplace parties.

The parties include:

- Persons conducting a business or undertaking;

- Persons in control of fixtures, fittings or plant at a workplace;

- Designers of plant, substances or structures;

- Manufacturers of plant, substances or structures;

- Suppliers of plant, substances or structures;

- Installers of plant, substances or structures;

- Officers;

- Workers; and

- Others persons at the workplace.

Duties ? Persons Conducting a Business or Undertaking (PCBU)

The phrase ?business or undertaking? is intended to be read broadly and covers businesses or undertakings conducted by persons including PCBUs, principal contractors, head contractors, franchisors and the Crown.

A PCBU has a primary duty of care requiring them to, so far as is reasonably practicable, ensure the health and safety of workers and others who may be affected by the carrying out of work.

Section 19 of the WHS Bill sets out the primary duty of care including:

- ensuring so far as is reasonably practicable the health and safety of workers; and

- ensuring so far as is reasonably practicable the health and safety of others affected by the business or undertaking

The duty includes providing:

a) safe working environment;

b) safe plant and structures;

c) safe systems of work;

d) safe use, handling and storage of plant and substances;

e) adequate facilities;

f) adequate information instruction and training; and

g) monitoring of the workplace.

A PCBU has a duty of care to others who may be affected by the business or undertaking, for example, if a building site has loads being lifted over a footpath, there is a duty of care to pedestrians. A mechanical workshop may have a sign saying ?no visitors past the front office? because of the duty of care to visitors.

A PCBU is also required to:

- facilitate the election of health and safety representatives;

- assist them in their functions where called for under the legislation;

- set up and facilitate a health and safety committee where the conditions set out in the legislation have been met; and

- establish issue resolution procedures.

Duties ? Persons in Control

There may also be duties imposed on those who have control of workplaces. A high-rise building may hold many businesses. The building manager has control over certain aspects of these workplaces such as lighting, sanitation, air-conditioning and access and egress, e.g. the lifts and staircases.

Duties ? Officers

Under the WHS Act the duties on Officers are positive and proactive duties. Under pre-harmonisation legislation personal liability of officers is that officers will be attributed personal liability for breaches of the company of its WHS obligations.

The trigger for that liability ranges from deemed liability (in NSW, Queensland and Tasmania), to liability for failing to take reasonable care to prevent the contravention (in Victoria, South Australia, the Northern Territory and shortly in the ACT) and liability only in the event that the offence was committed with the consent, connivance or is attributable to any neglect on the part of the officer (in Western Australia).

Despite the range of liabilities, all three position have one thing in common, the officer will be personally liable only if their company commits an offence.

The WHS Act defines an officer as:

> (a) a director or secretary of the corporation; or

> (b) a person:

? (i) who makes, or participates in making, decisions that affect the whole, or a substantial part, of the business of the corporation; or

? (ii) who has the capacity to affect significantly the corporation?s financial standing; or

? (iii) in accordance with whose instructions or wishes the directors of the corporation are accustomed to act.

And defines the duties of an Officer as exercising due diligence which includes:

> acquiring and keep up to date knowledge of WHS matters in relation to the undertaking;

> understanding the operations and the associated risks and hazards;

> ensuring appropriate resources, including advice, and processes to identify risks and then minimise or eliminate those risks;

> ensuring that there are processes for receiving and considering information about risks, hazards and incidents and responding in a timely manner; and

> to ensure that there are processes and resources for complying with the duties and obligations under the Act.

Duties ? Workers

A ?worker? is a person who carries out work in any capacity for a PCBU, including work in any of the capacities listed in the provision. The examples of workers in the provision are illustrative only and are not intended to be exhaustive. That means that there will be other kinds of workers that are not specifically listed in this clause (e.g. students on clinical placement and bailee taxi drivers).

The term ?work? is not defined but is intended to include work, for example, that is carried out:

1. under a contract of employment, contract of apprenticeship or contract for services;

2. in a leadership role in a religious institution, as part of the duties of a religious vocation or in any other capacity for the purposes of a religious institution;

3. as an officer of a body corporate, member of the committee of management of an unincorporated body or association or member of a partnership; and

4. as practical training as part of a course of education or vocational training.

Whether a person is a worker is to be decided on the facts of the case. It is important to note that the WHS Act places obligations on PCBU?s for the safety of contractors. This relationship can be complex and the Act and guidance material should also be examined to find out just who is responsible for WHS in principal-contractor relationships.

Workers have duties to:

- take reasonable care for their own safety;

- take reasonable care for the safety of others;

- comply with the reasonable instructions of a PCBU; and

- cooperate with the PCBU?s reasonable policies or procedures for health and safety.

The worker?s duty does not stand alone. It complements the PCBU?s duty, and the worker needs to receive the appropriate information, instruction, training and supervision to properly fulfil his or her duty. Given this, it is the worker?s duty to act in good faith.

Extent of the worker?s duty of care

The duty applies to all levels from production worker or clerical worker to senior executive or manager. The worker?s duty to avoid causing harm to others may place greater responsibilities on managers and supervisors than on other staff. For example, a supervisor who directs that a particular task is done in a particular way clearly has responsibilities to the workers who are directly involved in performing the task, and to other workers and members of the public who may be affected by the way in which the task is done.

To meet the obligation placed on workers they must:

- Follow the PCBU?s instructions provided for WHS reasons.

- Use personal protective clothing and equipment that has been provided by the PCBU. This duty is dependent upon the PCBU providing proper instruction in its care, use and storage.

- Take good care of equipment provided in the interests of health and safety. In particular, the worker must not misuse or damage the equipment. It would be an offence to deliberately render fire-fighting equipment inoperative or to remove guards from dangerous machinery for no good reason. This point applies when PCBU?s have provided the necessary information, instruction and training in health and safety matters, and a worker?s actions to misuse or damage are quite deliberate.

- Report hazards that the worker cannot correct. The requirement is to report to the PCBU.? However, there could be a system in the workplace where workers report to their immediate supervisor or area manager. Where that person is also unable to correct the hazard, it should be reported to a more senior management person. Any procedure that sets up a chain of command or delegates the task of receiving hazard reports should ensure there is prompt action to fix the problem or refer it on to someone who can fix it.

The legal responsibility to ensure that workers are not exposed to hazards rests with PCBU?s. In addition, supervisors who do not follow an agreed reporting procedure could be affecting the safety and health of other people through an omission at work, and may be failing to comply with their duties as workers.

- Report injury or harm to health that is connected with the work activity. This applies to physical injuries and to the early symptoms of illness or disease that may be connected with work. For this reporting to occur, workers should have received information from the PCBU about the early symptoms of which they need to be aware.

For example, keyboard operators should be aware of the symptoms of occupational overuse injuries.

- Cooperate with the PCBU to allow the PCBU to carry out its duties under the Act. This complements the PCBU?s duty and means that workers should actively work with PCBU?s with the common aim of improving health and safety at the workplace. This duty means that workers must follow directions given by the PCBU in the interests of health and safety.

Duties ? Others

Others include people who may have reason to be at the workplace but are not a worker. The duties of others mirror the duties of workers in that they must take care of themselves, cooperate with the PCBU and not do anything to endanger the health and safety of others.

The WHS laws set out the duties and functions of different people in a workplace or those who service that workplace. When considering the application of legislation and specific responsibilities you will need to establish:

1. What role does the person have in the workplace e.g. worker, Officer?

2. What duties apply under the legislation e.g. reasonable care, due diligence?

3. Are there any additional duties placed on the person under the regulations or codes of practice?

4. Have they met those obligations and what evidence there is of that e.g. using PPE as instructed, receiving reports about health and safety performance and acting on them?

Condom conundrum: Porn industry ponders latex law

(AP) ? The show must go on, is the entertainer's credo, and it did just that in the nation's Porn Capital even after Los Angeles County voted to require performers to use condoms when filming sex scenes.

One of the industry's biggest stars, James Deen, reported for work, condom-free as usual, just hours after voters adopted the new law.

During a break in the action Thursday, however, Deen raised the same questions on the mind of everyone in LA's billion-dollar-plus porn industry: Can a planned court challenge get the new law tossed out before it is even implemented? Or, perhaps this time next year, will he be making films like "Atomic Vixens" and "Asian Fever Sex Objects" in some place like Las Vegas or Florida?

The law, listed on the ballot as Measure B, was passed by 56 percent of voters Tuesday. It won't take effect until election results are certified, which likely will be several more days. It could take months longer before county health officials decide how to enforce it and whether they must begin dispatching prophylactic police officers to keep a close eye on actors.

The Department of Public Health issued a terse statement with no timetable for developing an enforcement plan. There was no hint of whether there would be surprise inspections or if public employees would be paid to watch porn flicks to see if actors were complying.

The nation's adult entertainment industry, which is believed to generate as much as $7 billion a year in revenue, according to the trade publication Adult Video News, vigorously opposed the new law. It argued it is unneeded because of safeguards that include monthly venereal disease checks for all working actors.

They also maintained it would be costly and difficult to enforce and could drive the business out of Los Angeles' sprawling San Fernando Valley, taking with it as many as 10,000 jobs, including actors, directors, film editors and crafts and makeup people.

The main problem, they say, is that fans don't want to see actors using condoms.

"The last time we attempted to go all condom, our industry lost sales by over 30 percent," said Deen. "That's a huge hit to our economy."

Deen, who has appeared in more than 1,000 hardcore films over the past nine years and estimates he's been in about 4,000 sex scenes, said he's never been infected with any disease and he gets tested every two weeks.

"I love condoms, I think they're great and the safest thing you can do in engaging in sexual intercourse with a stranger," he said, adding he uses them in his personal life but not onscreen.

Industry officials, meanwhile, say the last reported case of HIV linked directly to work was in 2004. Since then, they add, about 300,000 films have been made.

Michael Weinstein, the nonprofit AIDS Healthcare Foundation's founder and president, disputes those figures, saying there have been other, more recent HIV infections, not to mention numerous cases of gonorrhea, chlamydia and other sexually transmitted diseases.

Weinstein, whose group led a petition campaign to place the measure on the ballot, says he plans to take his campaign statewide.

In the meantime, he says implementing and enforcing the new law should be easy.

"This is no different than supervising restaurants or nail salons or barbershops," Weinstein said. "You fill out forms, you are granted a permit and, periodically, somebody goes out and does spot inspections."

Easy to implement or not, porn producers say the cost of paying for permits will likely be steep and the drop-off in sales could bankrupt them.

"Certainly this is the biggest threat that I've seen to the industry in a very, very long time," said Steven Hirsch, chief executive of Vivid Entertainment Group, one of the largest purveyors of porn films, including celebrity sex tapes and popular X-rated parodies of "Batman" and "Superman" films. "There have been obscenity prosecutions, but this is something on a whole different level."

Hirsch, who co-founded Vivid 28 years ago, said he is confident the industry will get the law overturned on the grounds it violates filmmakers' First Amendment rights of free expression.

If it isn't overturned, he said his company will simply move production out of Los Angeles County to survive.

Several people who attended an emergency meeting of the industry's advocacy group, the Free Speech Coalition, last week, said porn producers have already been in touch with officials in Las Vegas and parts of Florida. In some instances, they said, tax incentives have been offered to lure them.

Through a quirk in county law, the industry might even be able to pack up and move just a few miles down the freeway to Pasadena or Long Beach.

Those municipalities, although located in Los Angeles County, have their own health departments, and Pasadena said earlier this week it won't enforce the new law.

That would be just fine for many actors and directors, who say they don't really want to leave their home base.

"People forget that porn people are people too," said Kylie Ireland, a veteran actress and director who has appeared in such films as "Being Porn Again" and "Calipornication."

"They forget that we have families and we are married and we have kids and we have lives and jobs and hobbies just like everybody else."
