Cert IV OHS, WHS Responsibilities and Legislative Requirements ...

General Duty of Care -

The Model Work Health and Safety legislation sets out duties of care on a wide number of workplace parties.

The parties include:

- Persons conducting a business or undertaking;

- Persons in control of fixtures, fittings or plant at a workplace;

- Designers of plant, substances or structures;

- Manufacturers of plant, substances or structures;

- Suppliers of plant, substances or structures;

- Installers of plant, substances or structures;

- Officers;

- Workers; and

- Others persons at the workplace.

Duties ? Persons Conducting a Business or Undertaking (PCBU)

The phrase ?business or undertaking? is intended to be read broadly and covers businesses or undertakings conducted by persons including PCBUs, principal contractors, head contractors, franchisors and the Crown.

A PCBU has a primary duty of care requiring them to, so far as is reasonably practicable, ensure the health and safety of workers and others who may be affected by the carrying out of work.

Section 19 of the WHS Bill sets out the primary duty of care including:

- ensuring so far as is reasonably practicable the health and safety of workers; and

- ensuring so far as is reasonably practicable the health and safety of others affected by the business or undertaking

The duty includes providing:

a) safe working environment;

b) safe plant and structures;

c) safe systems of work;

d) safe use, handling and storage of plant and substances;

e) adequate facilities;

f) adequate information instruction and training; and

g) monitoring of the workplace.

A PCBU has a duty of care to others who may be affected by the business or undertaking, for example, if a building site has loads being lifted over a footpath, there is a duty of care to pedestrians. A mechanical workshop may have a sign saying ?no visitors past the front office? because of the duty of care to visitors.

A PCBU is also required to:

- facilitate the election of health and safety representatives;

- assist them in their functions where called for under the legislation;

- set up and facilitate a health and safety committee where the conditions set out in the legislation have been met; and

- establish issue resolution procedures.

Duties ? Persons in Control

There may also be duties imposed on those who have control of workplaces. A high-rise building may hold many businesses. The building manager has control over certain aspects of these workplaces such as lighting, sanitation, air-conditioning and access and egress, e.g. the lifts and staircases.

Duties ? Officers

Under the WHS Act the duties on Officers are positive and proactive duties. Under pre-harmonisation legislation personal liability of officers is that officers will be attributed personal liability for breaches of the company of its WHS obligations.

The trigger for that liability ranges from deemed liability (in NSW, Queensland and Tasmania), to liability for failing to take reasonable care to prevent the contravention (in Victoria, South Australia, the Northern Territory and shortly in the ACT) and liability only in the event that the offence was committed with the consent, connivance or is attributable to any neglect on the part of the officer (in Western Australia).

Despite the range of liabilities, all three position have one thing in common, the officer will be personally liable only if their company commits an offence.

The WHS Act defines an officer as:

> (a) a director or secretary of the corporation; or

> (b) a person:

? (i) who makes, or participates in making, decisions that affect the whole, or a substantial part, of the business of the corporation; or

? (ii) who has the capacity to affect significantly the corporation?s financial standing; or

? (iii) in accordance with whose instructions or wishes the directors of the corporation are accustomed to act.

And defines the duties of an Officer as exercising due diligence which includes:

> acquiring and keep up to date knowledge of WHS matters in relation to the undertaking;

> understanding the operations and the associated risks and hazards;

> ensuring appropriate resources, including advice, and processes to identify risks and then minimise or eliminate those risks;

> ensuring that there are processes for receiving and considering information about risks, hazards and incidents and responding in a timely manner; and

> to ensure that there are processes and resources for complying with the duties and obligations under the Act.

Duties ? Workers

A ?worker? is a person who carries out work in any capacity for a PCBU, including work in any of the capacities listed in the provision. The examples of workers in the provision are illustrative only and are not intended to be exhaustive. That means that there will be other kinds of workers that are not specifically listed in this clause (e.g. students on clinical placement and bailee taxi drivers).

The term ?work? is not defined but is intended to include work, for example, that is carried out:

1. under a contract of employment, contract of apprenticeship or contract for services;

2. in a leadership role in a religious institution, as part of the duties of a religious vocation or in any other capacity for the purposes of a religious institution;

3. as an officer of a body corporate, member of the committee of management of an unincorporated body or association or member of a partnership; and

4. as practical training as part of a course of education or vocational training.

Whether a person is a worker is to be decided on the facts of the case. It is important to note that the WHS Act places obligations on PCBU?s for the safety of contractors. This relationship can be complex and the Act and guidance material should also be examined to find out just who is responsible for WHS in principal-contractor relationships.

Workers have duties to:

- take reasonable care for their own safety;

- take reasonable care for the safety of others;

- comply with the reasonable instructions of a PCBU; and

- cooperate with the PCBU?s reasonable policies or procedures for health and safety.

The worker?s duty does not stand alone. It complements the PCBU?s duty, and the worker needs to receive the appropriate information, instruction, training and supervision to properly fulfil his or her duty. Given this, it is the worker?s duty to act in good faith.

Extent of the worker?s duty of care

The duty applies to all levels from production worker or clerical worker to senior executive or manager. The worker?s duty to avoid causing harm to others may place greater responsibilities on managers and supervisors than on other staff. For example, a supervisor who directs that a particular task is done in a particular way clearly has responsibilities to the workers who are directly involved in performing the task, and to other workers and members of the public who may be affected by the way in which the task is done.

To meet the obligation placed on workers they must:

- Follow the PCBU?s instructions provided for WHS reasons.

- Use personal protective clothing and equipment that has been provided by the PCBU. This duty is dependent upon the PCBU providing proper instruction in its care, use and storage.

- Take good care of equipment provided in the interests of health and safety. In particular, the worker must not misuse or damage the equipment. It would be an offence to deliberately render fire-fighting equipment inoperative or to remove guards from dangerous machinery for no good reason. This point applies when PCBU?s have provided the necessary information, instruction and training in health and safety matters, and a worker?s actions to misuse or damage are quite deliberate.

- Report hazards that the worker cannot correct. The requirement is to report to the PCBU.? However, there could be a system in the workplace where workers report to their immediate supervisor or area manager. Where that person is also unable to correct the hazard, it should be reported to a more senior management person. Any procedure that sets up a chain of command or delegates the task of receiving hazard reports should ensure there is prompt action to fix the problem or refer it on to someone who can fix it.

The legal responsibility to ensure that workers are not exposed to hazards rests with PCBU?s. In addition, supervisors who do not follow an agreed reporting procedure could be affecting the safety and health of other people through an omission at work, and may be failing to comply with their duties as workers.

- Report injury or harm to health that is connected with the work activity. This applies to physical injuries and to the early symptoms of illness or disease that may be connected with work. For this reporting to occur, workers should have received information from the PCBU about the early symptoms of which they need to be aware.

For example, keyboard operators should be aware of the symptoms of occupational overuse injuries.

- Cooperate with the PCBU to allow the PCBU to carry out its duties under the Act. This complements the PCBU?s duty and means that workers should actively work with PCBU?s with the common aim of improving health and safety at the workplace. This duty means that workers must follow directions given by the PCBU in the interests of health and safety.

Duties ? Others

Others include people who may have reason to be at the workplace but are not a worker. The duties of others mirror the duties of workers in that they must take care of themselves, cooperate with the PCBU and not do anything to endanger the health and safety of others.

The WHS laws set out the duties and functions of different people in a workplace or those who service that workplace. When considering the application of legislation and specific responsibilities you will need to establish:

1. What role does the person have in the workplace e.g. worker, Officer?

2. What duties apply under the legislation e.g. reasonable care, due diligence?

3. Are there any additional duties placed on the person under the regulations or codes of practice?

4. Have they met those obligations and what evidence there is of that e.g. using PPE as instructed, receiving reports about health and safety performance and acting on them?

Condom conundrum: Porn industry ponders latex law

(AP) ? The show must go on, is the entertainer's credo, and it did just that in the nation's Porn Capital even after Los Angeles County voted to require performers to use condoms when filming sex scenes.

One of the industry's biggest stars, James Deen, reported for work, condom-free as usual, just hours after voters adopted the new law.

During a break in the action Thursday, however, Deen raised the same questions on the mind of everyone in LA's billion-dollar-plus porn industry: Can a planned court challenge get the new law tossed out before it is even implemented? Or, perhaps this time next year, will he be making films like "Atomic Vixens" and "Asian Fever Sex Objects" in some place like Las Vegas or Florida?

The law, listed on the ballot as Measure B, was passed by 56 percent of voters Tuesday. It won't take effect until election results are certified, which likely will be several more days. It could take months longer before county health officials decide how to enforce it and whether they must begin dispatching prophylactic police officers to keep a close eye on actors.

The Department of Public Health issued a terse statement with no timetable for developing an enforcement plan. There was no hint of whether there would be surprise inspections or if public employees would be paid to watch porn flicks to see if actors were complying.

The nation's adult entertainment industry, which is believed to generate as much as $7 billion a year in revenue, according to the trade publication Adult Video News, vigorously opposed the new law. It argued it is unneeded because of safeguards that include monthly venereal disease checks for all working actors.

They also maintained it would be costly and difficult to enforce and could drive the business out of Los Angeles' sprawling San Fernando Valley, taking with it as many as 10,000 jobs, including actors, directors, film editors and crafts and makeup people.

The main problem, they say, is that fans don't want to see actors using condoms.

"The last time we attempted to go all condom, our industry lost sales by over 30 percent," said Deen. "That's a huge hit to our economy."

Deen, who has appeared in more than 1,000 hardcore films over the past nine years and estimates he's been in about 4,000 sex scenes, said he's never been infected with any disease and he gets tested every two weeks.

"I love condoms, I think they're great and the safest thing you can do in engaging in sexual intercourse with a stranger," he said, adding he uses them in his personal life but not onscreen.

Industry officials, meanwhile, say the last reported case of HIV linked directly to work was in 2004. Since then, they add, about 300,000 films have been made.

Michael Weinstein, the nonprofit AIDS Healthcare Foundation's founder and president, disputes those figures, saying there have been other, more recent HIV infections, not to mention numerous cases of gonorrhea, chlamydia and other sexually transmitted diseases.

Weinstein, whose group led a petition campaign to place the measure on the ballot, says he plans to take his campaign statewide.

In the meantime, he says implementing and enforcing the new law should be easy.

"This is no different than supervising restaurants or nail salons or barbershops," Weinstein said. "You fill out forms, you are granted a permit and, periodically, somebody goes out and does spot inspections."

Easy to implement or not, porn producers say the cost of paying for permits will likely be steep and the drop-off in sales could bankrupt them.

"Certainly this is the biggest threat that I've seen to the industry in a very, very long time," said Steven Hirsch, chief executive of Vivid Entertainment Group, one of the largest purveyors of porn films, including celebrity sex tapes and popular X-rated parodies of "Batman" and "Superman" films. "There have been obscenity prosecutions, but this is something on a whole different level."

Hirsch, who co-founded Vivid 28 years ago, said he is confident the industry will get the law overturned on the grounds it violates filmmakers' First Amendment rights of free expression.

If it isn't overturned, he said his company will simply move production out of Los Angeles County to survive.

Several people who attended an emergency meeting of the industry's advocacy group, the Free Speech Coalition, last week, said porn producers have already been in touch with officials in Las Vegas and parts of Florida. In some instances, they said, tax incentives have been offered to lure them.

Through a quirk in county law, the industry might even be able to pack up and move just a few miles down the freeway to Pasadena or Long Beach.

Those municipalities, although located in Los Angeles County, have their own health departments, and Pasadena said earlier this week it won't enforce the new law.

That would be just fine for many actors and directors, who say they don't really want to leave their home base.

"People forget that porn people are people too," said Kylie Ireland, a veteran actress and director who has appeared in such films as "Being Porn Again" and "Calipornication."

"They forget that we have families and we are married and we have kids and we have lives and jobs and hobbies just like everybody else."

Peter F. sent me an interesting link commenting on the interpretations of the growth of the Antarctic ice:

The main person who was used as the source in both stories published on the very same day ? the story saying that the "growth of ice is puzzling" and the story saying that "the growth of ice has been explaining" ? is Paul Holland of the British Antarctic Survey (BAS). You might think that this Gentleman must suffer from schizophrenia.

Climate alarmists personify the scientific dishonesty at the beginning of the 21st century. To defend their indefensible proposition that the climate will be changing in a dangerous way in a few decades if not now, they use a simple tactic to interpret all weather phenomena.

Whenever the weather phenomena may be spun to resemble "global warming" or whenever they are viewed as unpleasant, they say that these weather phenomena are a part of a growing trend and this trend is caused by carbon dioxide. Whenever the weather phenomena are pleasant, ordinary, cool, or they just fail to agree with their overall theme, they dismiss them as irrelevant weather events that should be ignored.

The polar weather is a trivial example of this double-faced attitude by the crooks.

The Arctic sea ice area has experienced a decreasing trend in the last 33 years. So it's surely dangerous, caused by CO2, and will threaten the human civilization if not life on Earth.

It just happens that our planet has two poles.

The Antarctic sea ice area has experienced a growing trend in the last 33 years although the absolute rate is slower than the melting trend of the Arctic. Nevertheless, it's not as convenient because the warming should be "global", not "hemispherical", so the Antarctica isn't important or relevant for the climate, we hear. It's just the weather, the winds, and you should generally ignore the coldest continent.

That's a bizarre suggestion because both poles are equally important geographically and the Antarctica is the "real main representative" of a cold place on the Earth. In particular, the overall cold records were measured in the Antarctica, not the Arctic. I have no doubts that the relevant weather influences, the magnitude of weather variations, and the strength of the regions' interactions with the rest of the Earth's climate system (among other things) are different in the Antarctica and in the Arctic but what I resolutely refuse is the suggestion that one of these regions should be considered more important ? just because it agrees with the "theme" popular among the global warming demagogues.

The climate alarmists love and depend on sloppy, premature explanations. So their first explanation of a warming trend seen somewhere is the first possible cause they conveniently consider, the carbon dioxide, and they want to burn the witches as soon as possible. If and when and whenever their story behind this causal relationship breaks down in a similar way as it breaks down in the Antarctica, they also adopt the first possible explanation they may think of: it must be the winds, the debate is over, you are obliged to shut your mouth immediately. (In a similar way, the cooling trend between the 1940s and the 1970s ? that is being gradually eliminated by constant revisions of the weather history ? must have been caused by aerosols and the story is immediately over, too.)

Needless to say, the actual reasons behind both types of phenomena may be different and only careful science, and not premature, ideologically biased, bullying screaming, has a chance to reliably find these actual reasons.

You also often read fog about the climate models' predictions of a growing ice in the Antarctica. There's surely no problem with the climate models and the growing ice is just due to some increasing precipitation or something like that. The climate models hired as prostitutes by the dirty and stinky global warming demagogues are "required" to obey two main conditions and obey two principal tasks: they must retrodict all the ordinary, innocent, chaotically changing weather for the past and for the present because we have already observed that the weather behaved like that and it lacked any kind of "moral imperative". At the same time, the same climate models are obliged to predict a very dangerous weather for the future.

As you might imagine, it's not an easy task, not even for the raped and fudged prostitutes that the prevailing climate models of the current era are. You can't really predict catastrophic things for the next 20 or 50 years if the previous 20 or 50 years were completely innocent and, except for a less than 0.5 ?C change of the global mean temperature, trendless.

At any rate, there are some models and some basic facts about these models' predictions were deliberately kept in secret. One of them was whether they had predicted or they are predicting the gradual growth of the Antarctic sea ice that we have seen at least in the last 33 years. Finally, the truth was leaked. They didn't predict this sign of the trend. It's pretty clear that they are predicting a loss of the Antarctic sea ice, too. So at least for 50 percent of the poles, these climate model produce wrong predictions when it comes to the sign of the temperature trend. I say "at least" because even among the predictions whose sign or rough magnitude agree with the reality, the agreement may be just due to pure chance. 50% is a pretty high error rate which shows that you get equally "reliable" answers if you just throw dice as if you listen to the climate models.

As The Register rightfully says, the climate models simply can't be trusted if they have predicted a qualitatively wrong behavior at least for 50% of the cold regions. Make no doubts about it: the global warming demagogues will try to question even this elementary and unavoidable conclusions because their dishonesty knows no limits.

And that's the memo.

South Dakota's Child Obesity Rate RisesYour Health Journal | Your ...

Childhood obesity in South Dakota rose slightly during the 2011-2012 school year, with more than 15 percent of kids younger than 19 reported as obese.

The South Dakota Department of Health reports that 15.9 percent of children younger than 19 are obese in South Dakota, up slightly from 15.2 percent the previous year.

Health officials say obesity rates are up among all age groups. Still, South Dakota?s rate is below the national obesity rate of 19.6 percent for children 19 and under.

State Nutritionist Kristin Biskeborn (BIS?-kah-born) called the increase disappointing. She says overweight and obese children become obese adults who develop more chronic disease than their peers who had healthy weights as children.
